E-exporting.com Terms and Conditions of Use

e-exporting.com acts as an online venue and platform that enables Users to discover, communicate with, and connect with Buyers, Freight Forwarders, Logistics Service Providers, Shippers, and other businesses involved in international transportation and logistics.

The Website may allow Buyers or other Users to submit transportation, freight forwarding, logistics, shipping, or related service inquiries or requests for quotation ("RFQs"), and may allow Freight Forwarders and other relevant Service Providers to review and respond to such inquiries.

e-exporting.com does not itself act as a Freight Forwarder, carrier, customs broker, shipping line, transport operator, or other logistics service provider unless expressly stated otherwise for a particular service.

e-exporting.com does not participate in or become a party to contracts, agreements, shipments, transportation arrangements, or other transactions concluded between Users. All transactions, quotations, services, payments, shipments, documentation, customs procedures, cargo handling, and other arrangements between Users are solely the responsibility of the parties involved.

This Agreement shall not be deemed to create any partnership, joint venture, agency, employment, or other joint business relationship between e-exporting.com and any User.

User(s) means any individual or business entity/organization that legally operates in the country in which it is established and uses or has the right to use the services provided by e-exporting.com. Our services are available only to individuals and entities that have the legal capacity to enter into legally binding agreements under applicable law. Users must provide accurate and truthful registration information and must comply with all applicable laws and regulations when accessing or using the Website.

e-exporting.com advises its Users that while accessing and using the Website, they must follow and comply with all applicable laws and regulations, including those relating to international trade, transportation, customs, export controls, sanctions, and other applicable requirements. e-exporting.com is not responsible for consequences arising from a User's violation of applicable laws or regulations. e-exporting.com may, in its sole discretion and subject to applicable law, refuse or restrict access to its services to any person or entity.

This Agreement applies to all User(s), including visitors, registered Users, free Users, and paid Users who access or use the Website for any purpose. It also applies to any legal entity which may be represented by you under actual or apparent authority. Users may use the Website solely for lawful business and professional purposes related to the Services provided through the Website.

This Agreement applies to all e-exporting.com services offered on the Website, together with any additional terms and conditions that may apply to a specific service, subscription, package, or feature. In the event of a conflict or inconsistency between any provision of these Terms and the terms applicable to a specific service, the terms applicable to that specific service shall prevail to the extent of the conflict.

e-exporting.com may change, modify, amend, or update this Agreement from time to time. The amended Terms and Conditions shall become effective when posted on the Website, unless otherwise required by applicable law. If you do not agree to any changes, you must stop using the Services. Your continued use of the Website or Services after the updated Agreement has been posted will constitute your acceptance of the updated Terms, to the extent permitted by applicable law.

Website content includes its design, layout, text, images, graphics, software, databases, logos, trademarks, service marks, videos, and other materials. All title, ownership, and intellectual property rights in the Website and its original content shall remain with e-exporting.com, its affiliates, or its licensors, as applicable. The information provided on the Website is intended for general informational and business purposes. Users are responsible for conducting their own independent investigations and exercising their own business and professional judgment before entering into any transaction or arrangement with another User. e-exporting.com does not guarantee the accuracy, completeness, reliability, quality, or suitability of information provided by Users or third parties. e-exporting.com reserves the right, in its sole discretion and without any obligation, to correct errors, modify content, or make improvements to the Website and Services.

Trademark

"e-exporting", "e-exporting.com", and related names, logos, icons, and service marks are trademarks or service marks of e-exporting Ltd or their respective owners, as applicable. Unauthorized copying, modification, use, or publication of these marks is prohibited.

Copyright

All original content on the Website is protected by applicable copyright and intellectual property laws, except for third-party content and materials provided by Users or linked from third-party websites. e-exporting.com respects the intellectual property rights of others and expects its Users to do the same. Users may not copy, download, reproduce, distribute, resell, republish, or commercially exploit e-exporting.com content without prior written permission. URL's/Sub-Domain

Any URL, sub-domain, or related online address assigned by e-exporting.com to its Users, including paid and free Users, remains subject to the rights and control of e-exporting.com. e-exporting.com reserves the right to suspend, terminate, modify, or restrict access to such URL or sub-domain where reasonably necessary or permitted under this Agreement.

Links to third-party websites may be provided as a convenience to Users. e-exporting.com does not control third-party websites, services, content, products, or resources and is not responsible for their availability, accuracy, security, or privacy practices.

Users are advised to review the terms and conditions and privacy policies of third-party websites before using their services.

Most content and some features of the Website may be available to visitors free of charge. However, e-exporting.com reserves the right to modify, suspend, restrict, or terminate access to any area, feature, or Service of the Website at any time, subject to applicable law. e-exporting.com may limit, deny, or create different levels of access to the Website and its features for different Users, including free and paid Users.

e-exporting.com may temporarily or permanently suspend or terminate a User's account for reasons including, but not limited to:

• (a) Providing false, inaccurate, misleading, or fraudulent information;
• (b) Engaging in fraudulent, illegal, or unauthorized activities;
• (c) Breaching any provision of this Agreement;
• (d) Using the Website to send spam, unsolicited communications, or abusive messages;
• (e) Repeatedly posting duplicate, misleading, or irrelevant information or RFQs;
• (f) Impersonating another person or company or unlawfully using another company's name;
• (g) Attempting to gain unauthorized access to the Website, database, network, or related services;
• (h) Obtaining or attempting to obtain another User's username or password without authorization;
• (i) Posting or facilitating prohibited or unlawful goods or services;
• (j) Using the Website in a manner that may harm e-exporting.com, its Users, or third parties.

If e-exporting.com terminates a User's membership due to a violation of this Agreement, the User may not create another account to circumvent the termination unless authorized by e-exporting.com. Unless otherwise required by applicable law, membership or subscription fees already paid may not be refundable where termination results from the User's violation of this Agreement.

To become a Registered User, Users must complete the applicable registration process and provide accurate information, which may include name, contact information, company information, business details, and other information required by e-exporting.com. e-exporting.com may establish an account ("Account") and assign a User ID and password for access to the Account. Users are responsible for maintaining the confidentiality of their Account credentials and for all activities conducted through their Account.

If you register on behalf of a business entity, you represent that: (a) you have the authority to bind that entity to this Agreement; (b) the information provided during registration is true, accurate, current, and complete; and (c) you will promptly update the information when necessary.

Registered Users may use the Website to communicate with other Users, submit or respond to RFQs, request or provide logistics-related services, and use other features made available by e-exporting.com. By becoming a Registered User, you acknowledge that certain information may be made available to other Users where necessary to provide the Services, subject to our Privacy Policy.

e-exporting.com may refuse, suspend, or terminate registration or access where permitted under this Agreement or applicable law.

Personal information supplied by Users during the use of the Website is governed by our Privacy Policy. Please refer to our Privacy Policy for information regarding how e-exporting.com collects, uses, stores, protects, and shares personal information.

Users are responsible for ensuring that personal or business information submitted to the Website may lawfully be provided and used for the purposes for which it is submitted.

Some content displayed on the Website may be provided or posted by third parties or Users. Users may post information, company profiles, service descriptions, RFQs, inquiries, logistics requirements, shipping requirements, offers, quotations, images, documents, and other content in sections of the Website where such functionality is provided. e-exporting.com is not the author of User-generated content and does not guarantee its accuracy, completeness, legality, quality, or reliability. The User who submits or publishes content is solely responsible for such content and for the consequences of its publication or use.

Users grant e-exporting.com a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and use the content submitted by them solely to the extent necessary to operate, provide, promote, and improve the Website and Services.

e-exporting.com reserves the right to remove, restrict, modify, or disable access to any content that it reasonably believes violates this Agreement, applicable law, or the rights of third parties. e-exporting.com may cooperate with governmental authorities, law enforcement agencies, or other authorized parties where required by applicable law.

e-exporting.com acts as a platform and content facilitator and does not assume responsibility for User-generated content.

e-exporting.com provides an online platform for exchanging information and facilitating connections between Buyers, Freight Forwarders, Logistics Service Providers, Shippers, and other Users. The Website may facilitate the submission of RFQs and the communication of quotations or service offers between Users. e-exporting.com does not represent the Buyer, Freight Forwarder, carrier, shipper, or other User in any specific transaction unless expressly agreed otherwise.

e-exporting.com does not control and is not responsible for: the quality, safety, legality, availability, or suitability of any service; the ability of a User to provide or receive a service; the accuracy of quotations or information submitted by Users; the performance of transportation or logistics services; cargo handling, customs clearance, documentation, insurance, delivery, or payment; or the completion or performance of any agreement between Users.

Users acknowledge that there may be risks in dealing with businesses or individuals located in other countries. e-exporting.com may use reasonable measures to review or verify certain User information; however, no verification process can guarantee the identity, financial standing, legal status, qualifications, licenses, or performance of any User. Users are responsible for conducting their own due diligence before entering into any agreement, shipment, transaction, or business relationship with another User.

Users fully assume the risks associated with their interactions and transactions with other Users. Such risks may include, but are not limited to, inaccurate information, fraud, misrepresentation, unsatisfactory services, failure to meet specifications, delays, payment defaults, documentation errors, customs issues, transportation incidents, cargo loss or damage, breach of contract, and other commercial or operational risks.

The features and Services on the Website are provided on an "as is" and "as available" basis, subject to applicable law. e-exporting.com expressly disclaims, to the maximum extent permitted by applicable law, warranties regarding the condition, quality, durability, performance, accuracy, reliability, completeness, availability, or suitability of the Website, its content, or Services for any particular purpose. e-exporting.com does not represent or warrant that information provided by Users is accurate, complete, current, reliable, or free from errors. e-exporting.com does not warrant or guarantee the performance, quality, legality, safety, availability, or suitability of any transportation, freight forwarding, logistics, or other service offered by Users. Any information, quotation, offer, document, or other material obtained through the Website is used at the User's own discretion and risk.

Under no circumstances shall e-exporting.com be liable for any delay, failure, interruption, or unavailability of the Website or Services resulting directly or indirectly from circumstances beyond its reasonable control, including Internet failures, computer or telecommunications failures, power failures, labor disputes, riots, civil disturbances, fires, floods, storms, natural disasters, war, governmental actions, court orders, or non-performance of third parties.

Users agree to indemnify and hold harmless e-exporting.com, its affiliates, directors, officers, employees, and representatives from claims, losses, liabilities, damages, costs, and expenses arising from: the User's use of the Website; the User's breach of this Agreement; information or content submitted by the User; the User's transactions or business relationships with other Users; violation of applicable law or third-party rights; or claims arising from services, shipments, goods, or transactions arranged between Users.

All notices or demands to a User may be delivered by email, courier, registered or certified mail, or by posting the notice on an area of the Website that is publicly accessible without charge, using the contact information provided by the User.

A notice shall be deemed received when it is successfully transmitted to the User's registered email address or when it is posted on the Website, subject to applicable law.

This Agreement, together with the Privacy Policy and other applicable terms of e-exporting.com, shall be governed by the applicable laws of the United Arab Emirates, unless otherwise required by applicable law or expressly agreed in writing.

Any dispute arising out of or relating to this Agreement or the use of the Website shall be subject to the jurisdiction of the competent courts of the United Arab Emirates and/or the relevant emirate in which e-exporting Ltd is legally registered, subject to applicable law.

Headings are for reference purposes only and do not define, limit, or otherwise affect the scope of any provision of this Agreement.

e-exporting.com's failure to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.

e-exporting.com shall have the right to assign its rights and obligations under this Agreement in connection with a merger, acquisition, restructuring, sale of assets, or transfer of its business, subject to applicable law.

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Calls to e-exporting.com may be recorded or monitored for quality assurance, training, security, or customer service purposes, subject to applicable law and where required, appropriate notice or consent.

This Agreement and the Privacy Policy constitute the entire agreement between the User and e-exporting.com regarding access to and use of the Website and Services, superseding prior agreements relating to the same subject matter.

e-exporting.com may provide specialized services to Buyers or business customers that submit transportation, freight forwarding, logistics, or other service requirements through the Website.

Any specific terms applicable to such services, including subscription, RFQ, sourcing, communication, advertising, or other services, may be provided separately and shall form part of the applicable agreement between the User and e-exporting.com.

Unless expressly agreed otherwise in writing, e-exporting.com acts only as a platform facilitating connections and communications between Users and does not become a party to any transportation, freight forwarding, logistics, or other commercial agreement between Users.
